The Federal Circuit affirmed the decision of the Patent Trial and Appeal Board that challenged claims of ST Case1Tech LLC’s patent that relates to systems for and methods of automatically adjusting audio levels in user-worn devices in order to improve the user’s situational awareness are obvious over prior art. The court said that the board had substantial evidence for the factual findings underpinning its determination of obviousness under the director’s preferred claim construction.
