The Federal Circuit reversed the Patent Trial and Appeal Board’s claim construction in Netflix Inc.'s appeal of an inter partes review of DivX LLC’s patent that covers systems for streaming partly encrypted media content. The court reversed the board’s construction of a claim limitation, concluded that it is the “encrypted portions” of frames of video, and not the “encryption information,” that must be located “within the requested portions of the selected stream of protected video,” and held that the claim limitation, so construed, is taught by the asserted prior art.
