The Federal Circuit affirmed the decision of the Patent Trial and Appeal Board that challenged claims of Cases2Tech LLC’s patent that describes and claims noise-suppressing earpieces and methods for using them are unpatentable as obvious over and anticipated by prior art, in an inter partes review by Samsung Electronics Co. According to the court, the board’s claim construction was supported by substantial evidence.
