The Federal Circuit affirmed a federal district court in Texas’s entry of judgment of non-infringement in Barrette Outdoor Living Inc.'s action against Fortress Iron LP and Fortress Fence Products LLC relating to patents that describe a fencing assembly featuring pivoting, sliding connectors that connect pickets to rails. The appeals court said that the district court correctly construed the patent claims as limited to integral bosses and projections, and correctly determined that the asserted patents’ specification and prosecution histories would allow a skilled artisan to ascertain the claims’ scope with reasonable certainty.
