The Federal Circuit affirmed the decision of the Patent Trial and Appeal Board holding challenged claims of ST Case1Tech’s patent that discloses an always-on headwear recording system unpatentable as obvious over prior art, in inter partes reviews by Samsung Electronics Co. and Samsung Electronics America Inc. The court rejected the claim construction challenge because Case1Tech forfeited its present argument by not making it to the board, and the argument is incorrect in light of the intrinsic evidence.
