A federal district court in New York adopted Samtech LLC’s proposed construction of its patent for the ornamental design of a military style jacket, with one correction, in this infringement action against Brooklyn Armed Forces LLC, Brooklyn A F Inc., California Surplus Inc., and the Sportsman’s Guide LLC. According to the court, the groups failed to show that the elements of the design are so unclear in the illustrations that a detailed verbal description is necessary to properly inform the finder of fact of the scope of the claim.
