The district of New Jersey construed disputed claim terms in Teva Branded Pharmaceutical Products R&D Inc., Norton (Waterford) Ltd., and Teva Pharmaceuticals USA Inc.'s action against Amneal Pharmaceuticals of New York LLC, Amneal Ireland Limited, Amneal Pharmaceuticals LLC, and Amneal Pharmaceuticals Inc. for infringement of patents relating to ProAir® HFA (albuterol sulfate) Inhalation Aerosol. According to the court, the claim terms at issue don’t require the presence of an active drug, and no further construction is necessary.
