A federal district court in New York granted in part and denied in part Aero Global LLC’s motion for attorneys’ fees in AML IP LLC’s action for infringement of a patent that relates to novel and improved methods and apparatuses for conducting electronic commerce. The court determined that this case is exceptional due to the substantive weakness of AML’s litigating position, but didn’t find bad faith sufficient to hold AML’s counsel jointly and severally liable.
