The Federal Circuit affirmed the decision of a federal district court in Texas granting Vizio Inc.'s motion for attorneys’ fees in Ortiz & Associates Consulting LLC’s patent infringement action. The appeals court held that the district court didn’t abuse its discretion in determining that this case was exceptional, both because Ortiz’s litigation position was substantively weak and because its litigation conduct was unreasonable.
