The Federal Circuit affirmed the decision of the District of Delaware awarding Nextremity Solutions Inc. attorneys’ fees in Extremity Medical LLC’s action for infringement of a patent that relates to orthopedic implant devices. The appeals court said that the district court didn’t err by finding the infringement action exceptional and awarding attorneys’ fees and costs to Nextremity in the amount of $52,573.
