Some challenged claims of The Brigham and Women’s Hospital Inc.'s patent that discloses sensor arrays for detecting biomolecules and methods of use are unpatentable as anticipated by and obvious over prior art, the Patent Trial and Appeal Board said, in an inter partes review by PreOmics GmbH and Biognosys AG. The board determined that some challenged claims are anticipated by and obvious over a journal article that describes a study utilizing stable isotope labeling by amino acids in cell culture (SILAC)-based quantitative proteins to two forms of carbon nanoparticles.
