The Patent Trial and Appeal Board said that challenged claims of Ideahub Inc.'s patent for a method and apparatus for an adaptive Hypertext Transfer Protocol streaming service using metadata of media content are unpatentable as anticipated by and obvious over prior art, in an inter partes review by Vudu LLC. According to the board, the challenged claims are anticipated by and obvious over prior art consisting of the second finalized draft of the MPEG DASH standard and specifies a hierarchical model for DASH. And the board denied Ideahub’s motion to amend with substitute claims.
