The Court of Appeals for the Eleventh Circuit affirmed in part and reversed in part a federal district court’s grant of summary judgment to the Gorilla Glue Co. in J-B Weld Co.'s action against GG for false advertising and trade dress infringement and dilution under federal and state law. The Eleventh Circuit noted J-B’s allegation that GG’s GorillaWeld adhesive is falsely advertised as a “steel bond epoxy,” but affirmed the district court’s finding as to the false advertising claims because J-B has not shown that consumers care whether GorillaWeld uses MMA chemistry or epoxy chemistry or whether GorillaWeld actually contains ...
