Case: Copyrights & Trademarks/Summary Judgment (C.D. Cal.)

A federal district court in California granted Get My Auto LLC and Raz Motor Group Inc.'s motion for summary judgment on DealersGear Inc.’s copyright infringement, trademark infringement, emotional distress, and tortious interference claims. The court said that DealersGear failed to show that Get My Auto and Raz had access to the copyrighted materials and that the works weren’t sufficiently similar. And the court found that DealersGear’s unregistered mark was merely descriptive and didn’t obtain secondary meaning, and that DealersGear failed to submit evidence of false statements.
