A federal district court in New York granted in part and denied in part Cengage Learning Inc.; Bedford, Freeman & Worth Publishing Group LLC; Macmillan Holdings LLC; Elsevier Inc.; Elsevier B.V.; and McGraw Hill LLC’s motion to strike Google LLC’s affirmative defenses in this copyright and trademark infringement action relating to digital copies of textbook and educational works. The court denied the motion to dismiss the statute of limitations, DMCA, estoppel, laches, waiver, and unclean hands affirmative defenses, and granted the motion to dismiss the in pari delicto and Copyright Act preemption affirmative defenses.
