Thomas Family Farm LLC’s motion to dismiss Seattlehaunts LLC’s copyright infringement claim was denied by a federal district court in Washington. The court concluded that Seattlehaunts had plausibly alleged a claim for copyright infringement because (1) Seattlehaunts alleged that it owns a valid copyright in the Wondell Graphic at issue; (2) attached its copyright registration certificate and the assignment agreement that allegedly transferred ownership of the copyright to Seattlehaunts; and (3) alleged that TFF used Seattlehaunts’ copyright in the Wondell Graphic without authorization on TFF’s website, social media pages, and various print forms at TFF’s farm.
