A federal district court in New York granted in part and denied in part Google LLC’s motion to dismiss Cengage Learning Inc.; Bedford, Freeman & Worth Publishing Group LLC; Macmillan Holdings LLC; Elsevier Inc.; Elsevier B.V.; and McGraw Hill LLC’s action for vicarious and contributory copyright infringement, trademark infringement, and unfair and deceptive business practices, relating to online sellers’ use of the Google shopping platform to advertise digital copies of educational works. The court dismissed the claims for vicarious copyright infringement and unfair and deceptive business practices.
