A federal district court in New York denied in part Tulip Apparels LLC and Tulip Creations Private Limited’s motion to dismiss JAPNA Inc.’s trade secret misappropriation, copyright infringement, and breach of fiduciary duty claims related to apparel. The court dismissed the claims for misappropriation of distribution process trade secret and breach of fiduciary duty for lack of personal jurisdiction, but said that it has jurisdiction with respect to the claims for misappropriation of customer lists and copyright infringement.
