A federal district court in Nebrasksa denied eScholar LLC’s motion for preliminary injunction and granted in part and denied in part the Nebraska Department of Education’s motion to dismiss this copyright infringement and trade secrets misappropriation action. eScholar alleged that the department breached a software license agreement by reverse-engineering its Uniq-ID software, and in doing so infringed its registered copyrights and violated the Nebraska Trade Secrets Act. The court dismissed the copyright and trade secrets claims, but ruled that contract claims can go forward.
