A federal district court in Alabama denied EBSCO Industries Inc.'s motion to dismiss The McClatchy Company LLC and Gannett Co. Inc.'s action for infringement of copyrighted photographs and newspaper materials relating to the 1993-1994 Kansas State University football team. According to the court, it’s not clear from the face of the complaint that the claims are barred by the Copyright Act’s three-year statute of limitations.
