Case: Copyrights/Summary Judgment (M.D. Ga.)

A federal district court in Georgia granted in part and denied in part Design Mart LLC’s motion for summary judgment on this infringement action against Matthews International Corporation relating to copyrights for 202 gravestone designs. The court granted Design Mart summary judgment on the factual and legal copyright element of its copyright infringement claim for 175 designs, but determined that genuine fact disputes exist as to whether Matthews copied the remaining designs, as well as on statutory and actual damages.
