A federal district court in Florida denied Vanguard Productions LLC’s motion for summary judgment and granted Frazetta Properties LLC summary judgment on its copyright infringement claim based on book cover art for fantasy and science fiction novels. The court said that Frazetta owned the copyrights in the original images. And the court said that no reasonable jury could find that Vanguard’s publication wasn’t directly copied from Frazetta’s registered mark, and that Vanguard’s actions didn’t constitute fair use.
