The Ninth Circuit affirmed the decision of a federal district court in California denying a photographer’s motions for summary judgment and for judgment as a matter of law, following a jury verdict finding that High Voltage Tattoo wasn’t liable for copyright infringement. According to the appeals court, the district court’s motion for summary judgment wasn’t reviewable on appeal, and the district court didn’t err by denying JMOL because the jury’s verdict was based on an application of the intrinsic test.
