A federal district court in Colorado denied in part and granted in part Otter Products LLC and TreeFrog Developments Inc.'s motion for summary judgment in Capture Eleven LLC’s action for infringement of photographs taken after the parties’ written contract was terminated. According to the court, the existence of Otter’s implied license presents a genuine factual dispute for trial. But the court said that the undisputed facts show that Otter owns a subset of the images, and it dismissed TreeFrog from the action.
