The Second Circuit affirmed the decision of a federal district court in New York granting summary judgment to Vimeo Inc. and Connected Ventures LLC on this copyright infringement action by rights holders of musical recordings. The appeals court affirmed the district court’s ruling that the rights holders failed to demonstrate a disputed issue of material fact as to whether Vimeo had the right and ability to control infringing activity on its website or whether Vimeo’s employees had red flag knowledge of users’ infringement.
