The Tenth Circuit affirmed the decision of a federal district court in Oklahoma granting Netflix Inc. and Royal Goode Productions LLC summary judgment on Whyte Monkey Productions LLC’s action for copyright infringement relating to the use of eight videos in “Tiger King: Murder, Mayhem and Madness.” The court said that as to seven videos, Whyte Monkey waived its new theory on appeal, and that the use of the final video was fair use.
