Case: Copyrights/Procedure (D. Mass.)

The District of Massachusetts granted in part and denied in part Emerald Publishing Limited and Emerald Group Publishing Inc.'s motion to dismiss a professor’s action for copyright infringement, breach of contract, and declaratory relief relating to journal articles. The court granted Emerald’s motion to dismiss the copyright claims to the extent they are based on Emerald’s failure to include copyright notices in journal republications, denied the motion to dismiss the breach of contract claim, and granted the motion to dismiss the claim for declaratory relief to the extent it requests rescission.
