The Ninth Circuit affirmed the decision of a federal district court in California dismissing an artist and model’s copyright infringement action against a recording artist relating to social media photographs. According to the appeals court, the mere fact that the artist posted his photos on his social media page falls short of plausibly alleging that the recording artist had access to and saw the photos, and the artist didn’t show that the selection and arrangement in the photos are substantially similar.
