A federal district court in New York denied Sinclair Broadcasting Group Inc.'s motion to dismiss a photographer’s copyright infringement based on the publication of his video footage of a starving polar bear. The photographer claimed Sinclair embedded the video in online articles without first obtaining a license. The court held that the photographer stated a prima facie case for copyright infringement and that Sinclair didn’t meet its burden of proving a fair use defense on the sheer basis of the pleadings.
