The Sixth Circuit reversed and remanded the decision of a federal district court in Michigan granting Thang Inc. and a band member summary judgment on another band member’s estate’s action seeking a declaration of joint ownership of recordings and an accounting of royalties due. The appeals court said that genuine disputes of material fact preclude judgment as a matter of law, and that, viewing the facts in the light most favorable to the estate, part of the copyright ownership claim is timely.
