The Ninth Circuit affirmed in part, reversed in part, and remanded the decision of a federal district court in California granting Walt Disney Picture’s motion for JMOL and a new trial on the issue of apportionment of profits, in Reardon LLC and Rearden MOVA LLC’s action for vicarious copyright infringement relating to facial motion capture software. The appeals court reversed the district court’s grant of JMOL, because Rearden introduced legally sufficient evidence for a jury to conclude that Disney had the practical ability to stop or limit the infringing conduct by a contractor.
