The Third Circuit affirmed the decision of a federal district court in Pennsylvania denying American Society for Testing and Materials’ motion for a preliminary injunction in its copyright infringement action against UpCodes Inc. relating to copyrighted ASTM standards that are referenced in the International Building Code. The appeals court affirmed the district court’s finding that UpCodes is likely to succeed on the merits of its fair use defense.
