A federal district court in Washington granted Microsoft Corp.’s motion for partial summary judgment on the Search People Enterprises Ltd.’s first sale affirmative defense. The court held that the first sale doctrine didn’t apply to product keys for the software, and that the download of software by customers constituted reproduction, not redistribution.
