A federal district court in New York granted Morning Bee Inc. and Apple Inc.'s motion to dismiss a photographer’s action for infringement of ten copyrighted photographs, displayed together in an exhibit entitled “Airportraits,” that briefly appear in the background of the documentary “Billie Eilish: The World’s A Little Blurry.” According to the court, the use of the photographs is de minimis, and the transformative, fleeting, and incidental use of the photographs constitutes fair use.
