A federal district court in Virginia granted The Washington Free Beacon’s motion to dismiss a professional photographer’s copyright infringement action relating to the use of a photograph of a politician. According to the court, Free Beacon’s use of the photograph was transformative, the commercial nature of the use was minimal, and there was no significant market harm or usurpation.
