The Second Circuit affirmed the decision of a federal district court in New York dismissing a former congressman’s action for copyright infringement, breach of contract, and fraudulent inducement against a late night show host, American Broadcasting Companies Inc., and The Walt Disney Company, based on the airing of personalized videos made pursuant to requests using fictitious names. The appeals court affirmed the district court’s determination that the copyright claims were barred by the fair use doctrine and that he failed to state claims for breach of contract and fraudulent inducement.
