The Seventh Circuit vacated and remanded the decision of a federal district court in Illinois denying Dolls Kill Inc.'s request for disgorgeable profits in its copyright infringement action against MengEryt and 14 other Amazon storefronts for infringement of its “Teddy Deady Backpack.” The appeals court said that the district court erred in awarding statutory damages to Dolls Kill because the plain language of the Copyright Act leaves the choice of damages to the plaintiff.
