A federal district court in Washington granted in part and denied in part Promedev LLC’s motion to dismiss MaXXiMedia Advertising Co.'s counterclaims for trade secrets misappropriation, copyright infringement, violation of the Washington Consumer Protection Act, and fraudulent inducement and misrepresentation, in Promedev’s breach of contract action. The court denied Promedev’s motion to dismiss MaXXiMedia’s misappropriation of trade secrets counterclaim, and granted Promedev’s motion to dismiss MaXXiMedia’s counterclaims for violation of the WCPA, and fraudulent inducement and misrepresentation. And the court denied Promedev’s motions to strike portions of MaXXiMedia’s copyright infringement counterclaim and its demand for disgorgement of profits.
