The Seventh Circuit affirmed the decision of a federal district court in Illinois entering summary judgment in favor of CLEAResult Consulting Inc. on NEXT Payment Solutions Inc.'s action for trade secret misaproppriation and unjust enrichment relating to appointment scheduling software. The appeals court said that NEXT failed to come forward with evidence from which a jury could conclude that its FAST Tool software modules qualify as trade secrets, and that the district court didn’t abuse its discretion in precluding NEXT from arguing a new theory of unjust enrichment.
