Case: Trade Secrets/JMOL (9th Cir.)

The Ninth Circuit reversed and remanded the decision of a federal district court in California’s granting judgment as a matter of law to Medallia Inc., with instructions to reinstate the jury’s verdict, in EchoSpan Inc.'s trade secret misappropriation action. The appeals court said that the district court erred by concluding as a matter of law that EchoSpan wasn’t entitled to recover for Medallia’s unjust enrichment because EchoSpan didn’t apportion relief on a trade-secret-by-trade-secret basis.
