Cardi B, WMG Misused Rez Dogs Song to Make Miami Hit, Suit Says

July 4, 2024, 12:05 AM UTC

Cardi B infringed the copyright of a song featured in the FX hit series “Reservation Dogs” to create her song “Enough (Miami),” according to a new federal lawsuit.

The rapper’s unpermitted use of musical duo Kemika1956’s song “Greasy Frybread” has caused the artists financial losses and irreparable harm to their artistic reputations, according to a complaint filed Wednesday in the US District Court for the Southern District of Texas.

Kemika1956, composed of members Joshua Fraustro and Miguel Aguilar, also filed vicarious and contributory infringement claims against Atlantic Records and Warner Music Group. The group seeks an order requiring the defendants to recall and destroy all infringing copies, and a temporary restraining order to enjoin the defendants from further infringing their copyright.

Representatives for WMG, Atlantic Records, and Cardi B didn’t immediately respond to Bloomberg Law’s requests for comment.

Robert R. Flores PC represents Kemika1956.

The case is Fraustro v. Almanzar, S.D. Tex., No. 24-cv-00264, complaint filed 7/3/24.
