BuzzBallz Trademark Suit Against Big Sipz Moved to California

BuzzBallz LLC failed to keep its single-serving cocktail trademark and trade dress lawsuit from shifting out of its home state of Texas to upstart competitor Patco Brands’ base in California.

MPL Brands NV Inc.—which operates as Patco and produces Big Sipz—established that evidence and witnesses would be easier to access in California, the origin of the alleged infringement, said Texas federal judge Robert Pitman. He rejected BuzzBallz’ “half-hearted” bid to alternatively send the case to the Northern District of Texas because it was made in “the last few pages” of a response brief rather than its own motion to transfer. ...
