BuzzBallz LLC accused upstart canned-cocktail maker Patco Brands of copying its distinctive ball-shaped, single-serving alcoholic beverages and damaging its reputation with disparaging ads and posts on social media.
Texas-based BuzzBallz has been selling pina coladas, fruity margaritas, and chocolate martinis in brightly-colored, tennis-ball sized plastic pop-top containers in convenience stores, bodegas, and retail markets for more than a decade, according to a lawsuit filed Sept. 15 in the US District Court for the Western District of Texas.
