Buyer Entitled to Purchased Company’s Patent Case Settlement

Oyster Optics LLC’s settlement in a patent dispute with Coriant (USA) Inc. also covers Infinera Corp., another target of Oyster’s patent claims that later bought Coriant, the Federal Circuit said Thursday.

Oyster sued Coriant, Infinera, and others for infringing its telecommunications patents. Oyster and Coriant settled their dispute, and Oyster granted Coriant and its affiliates a license to its patents under their agreement. The agreement’s effective date was in June 2018.

Infinera acquired Coriant that October, and moved to end Oyster’s case against it as an affiliate of Coriant. The settlement agreement defined “affiliate” to include any party with more ...
