Nearly all of online retailer Overstock’s trademark suit against a Baltimore furniture outlet survived a dismissal bid, a Maryland federal court ruled Monday.
Asset Store LLC, which operates as Overstock Outlet, must face trademark and unfair competition claims from Beyond Inc.—Overstock’s corporate name—after a ruling by the US District Court for the District of Maryland. Overstock also kept alive its bid for punitive damages—"even if just barely"—on federal trademark claims, but it can’t win punitive damages on its state law claims, the court said.
