A nutritional supplement company failed to escape a $7 million award after the Sixth Circuit upheld a verdict that it stole broccoli extract ingredient trade secrets.
Jarrow Formulas Inc. hired an employee away from supplier Caudill Seed & Warehouse Co., who helped it steal trade secrets so it could make its own BroccoRahanin for its BroccoMax product, a Kentucky federal jury determined. Jarrow appealed the district court loss on several grounds, but Caudill adequately defined the secrets at issue and proved Caudill used it, while the jury appropriately calculated damages, the US Court of Appeals for the Sixth Circuit said. ...
