A lower court abused its discretion when it denied Brandy Melville an injunction prohibiting Redbubble Inc. from using its registered trademarks or any variations, the Ninth Circuit ruled Monday.
While a year passed between Brandy Melville’s notice and its suit, the appeals panel ruled that the delay didn’t show that the clothing company would be safe from future harms without an injunction.
