Bose Vanquishing of Koss Earbud Patent Appealed to Fed. Cir.

Koss Corp. appealed the invalidation of its wireless earbud patent to the Federal Circuit after a successful petition by Bose Corp., one of several companies Koss sued for allegedly infringing multiple patents.

Bose convinced the Patent Trial and Appeal Board in October that Koss’ U.S. Patent No. 10,469,934 B2 for a “System with Wireless Earphones” was obvious. PTAB held that an ordinarily skilled artisan would have had reason to combine an existing headset with existing software for downloading and streaming music as well as firmware updates.
