BMW Wins Restraining Order Blocking Patent Owner’s Foreign Suit

Bayerische Motoren Werke AG obtained a temporary restraining order preventing a patent owner from pursuing an injunction in Germany over the automaker’s use of Qualcomm Snapdragon circuits in vehicles.

There is substantial likelihood of irreparable harm to BMW and the Texas federal court’s authority should Onesta IP LLC obtain a European injunction against BMW involving US patents, Judge Alan Albright said in a Tuesday order.

Onesta has until Dec. 23 to file an opposition to extending the TRO. Albright said he’ll later evaluate whether a full antisuit injunction against Onesta is necessary.
