Patent firm Onesta IP LLC is seeking emergency relief at the Federal Circuit so it can maintain part of a German infringement lawsuit against BMW that asserts two US patents.
Onesta’s emergency stay motion filed Wednesday said that if “a temporary freeze of the Texas district court’s order is not granted, Onesta will be forced to fully and permanently dismiss its German case, effectively permitting the district court to nullify” a 2025 ruling of the Court of Justice of the European Union it says made it possible to litigate a US patent in a European jurisdiction.
